This document serves as both a Bill of Sale and a binding Spay/Neuter Agreement. Transfer of permanent ownership is strictly contingent upon the Buyer’s compliance with the terms below.

1. Spay/Neuter Requirements

The Buyer agrees to have the canine spayed or neutered by 12 months of age (or, in the case of females, following the first heat cycle).

  • Verification: Proof of surgery must be provided to the Breeder within 14 days of the procedure. Verification must include an invoice/certificate signed by a licensed veterinarian including their state license number.

  • Medical Extensions: If a veterinarian determines the canine is not physically or emotionally fit for surgery by the deadline, the Buyer must provide a written and signed veterinary statement. This statement must include a revised date for the procedure.

  • Breeding Restriction: This canine is sold as Pet Quality only. The Buyer agrees that this canine will not be used for breeding, whether intentional or accidental. Accidental breeding is deemed a result of negligence.

2. Breach of Contract & Penalties

Failure to provide proof of spay/neuter by the deadline constitutes a material breach of contract. In the event of a breach:

  • Reclamation: The Breeder maintains the right to seize the canine. The Buyer shall surrender the canine to the Breeder immediately without refund or compensation.

  • Offspring: Any offspring produced (intentional or accidental) shall legally become the property of Daniel Greiner.

  • Financial Penalties: The Buyer agrees to pay a penalty of $500.00 USD in addition to the original purchase price.

  • Legal Fees: The Buyer is responsible for all costs associated with the recovery of the canine, including transport, court costs, and reasonable attorney’s fees. Buyer Initials: ________ / Seller Initials: ________

    3. Health Guarantee & Maintenance

    • Initial Guarantee: The Breeder guarantees the canine is in healthy condition at the time of sale. The Buyer has 72 hours from the time of pickup/delivery to have the canine examined by a licensed veterinarian.

    • Vaccinations: The Buyer must follow the provided health record for all remaining boosters (Parvo/Distemper). Failure to complete the vaccine series as scheduled renders all health guarantees null and void.

    • Exclusions: This guarantee does not cover internal or external parasites (coccidia, giardia, worms, fleas), as these are common and treatable conditions.

    • Breeder Commitment & Disclosure: The Breeder stands behind every puppy produced and is committed to working with the Buyer to resolve health-related issues. However, for the Breeder to provide support or guidance, the Buyer must provide immediate and transparent notification of any health concerns.

      • Failure to notify the Breeder in a timely manner, or withholding medical information/veterinary records, limits the Breeder’s ability to evaluate the situation and may void the Breeder’s obligation to assist or provide restitution.

    • Veterinary Care: Should a life-threatening illness be detected within 72 hours, the Breeder requires a second opinion from the Breeder’s veterinarian. If confirmed, a refund of the purchase price (less the $200 non-refundable deposit) will be issued upon return of the canine. The Breeder is not responsible for any veterinary fees incurred by the Buyer.

4. Right of First Refusal & Rehoming

The Breeder’s goal is for every puppy to remain in its original home. However, if the Buyer can no longer care for the canine:

  • First Right of Return: The Buyer must notify the Breeder before attempting to rehome the canine. The Breeder maintains the “Right of First Refusal” to take the canine back.

  • No Third-Party Transfers: The canine may not be sold, given away, or surrendered to a shelter/third party without written consent from the Breeder.

  • Liability: If the Breeder approves a rehoming, the original Buyer remains liable for ensuring the spay/neuter requirements are met by the new owner. Buyer Initials: ________ / Seller Initials: ________

5. Terms of Sale & Jurisdiction

  • Deposits: All deposits are non-refundable and non-transferable.

  • Pickup: Puppies must be collected within 3 days of their scheduled departure date. A boarding fee of $20/dayapplies thereafter.

  • Governing Law: This contract is governed by the laws of the State of Michigan. Any legal disputes shall be settled within the jurisdiction of Eaton County.

  • Entirety: This document represents the entire agreement between the parties. Any changes must be made in writing and signed by both parties. Buyer Initials: ________ / Seller Initials: ________
